Publisher: TINKAVU LLC, a Florida limited liability company doing business as Extra Turn Games ("Tinkavu LLC", "Extra Turn Games", "we", "us", "our").

Please read these Terms of Use and End User License Agreement ("Terms") carefully before downloading, installing, or using Moonstone Companion, also published as Companion for Moonstone ("the App"). By tapping "I UNDERSTAND & AGREE" on first launch, or by continuing to use the App, you accept these Terms. If you do not accept them, do not install or use the App.

1. Acceptance & Eligibility

By using the App you confirm that:

  1. You are at least 13 years old. If you are between 13 and the age of majority in your jurisdiction, you represent that you have obtained the consent of a parent or legal guardian to use the App.
  2. You are old enough to consent to the processing of your personal data in your country of residence.
  3. You have the legal capacity to enter into a binding agreement.
  4. Your use of the App complies with all applicable laws in your jurisdiction.

We reserve the right to refuse service to anyone for any reason at any time, consistent with applicable law.

2. Relationship to Apple

These Terms are between you and TINKAVU LLC only, and not with Apple Inc. TINKAVU LLC, not Apple, is solely responsible for the App and its content. These Terms may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions, and in the event of a conflict the Apple Media Services Terms and Conditions govern.

3. License Grant

Subject to these Terms, Tinkavu LLC grants you a personal, limited, non-exclusive, non-transferable, revocable license to:

  • Download, install, and use the App on any Apple-branded product that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, and on Android devices you own or control.
  • Use the App solely for your personal, non-commercial purposes.

The App is provided free of charge. This license does not include any right to sublicense, sell, resell, transfer, assign, or otherwise exploit the App or any portion of it.

4. License Restrictions

You may not:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent that restriction is prohibited by applicable law.
  • Copy, modify, adapt, translate, or create derivative works based on the App or its content.
  • Sell, rent, lease, sublicense, or transfer the App or any rights to it.
  • Remove, alter, or obscure any proprietary notices, labels, or branding in the App.
  • Use the App in any manner that could impair, overburden, or damage our servers or networks.
  • Circumvent or attempt to circumvent any technical measure we use to control access to features or data.
  • Scrape, crawl, index, or systematically extract any data from the App or its backend services by automated means.
  • Attempt to access accounts, databases, or systems you are not authorized to access.

5. Your Account

Some features, including leagues, tournaments, the Player Finder, clubs, and cloud sync, require an account. You are responsible for the accuracy of the information you provide and for all activity that occurs under your account.

You may delete your account at any time from Settings → Account → Delete My Account. Deletion is immediate. It removes your profile, your troupes, and your active-league memberships; data from leagues already marked finished is anonymized (your name stripped) rather than deleted, as described in our Privacy Policy. A lighter-weight Settings → Account → Remove My Information option is also available if you want to clear your personal details without closing the account.

6. Acceptable Use & Community Rules

There is no tolerance for objectionable content or abusive users.

You agree to use the App only for lawful purposes and in a manner consistent with these Terms. You will not submit, post, or transmit any content that is:

  • unlawful, defamatory, harassing, threatening, or abusive;
  • hateful or discriminatory on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or age;
  • sexually explicit, obscene, or pornographic;
  • violent, or that promotes or glorifies violence or self-harm;
  • infringing on anyone's intellectual property or privacy rights;
  • deceptive, fraudulent, spam, or an impersonation of another person or entity;
  • or otherwise objectionable.

You further agree that you will not:

  • Violate any applicable local, national, or international law or regulation.
  • Harass, bully, stalk, threaten, or otherwise abuse other users of the App. The Player Finder is designed to help players connect; it must not be used to stalk, spam, or contact users who have not consented.
  • Upload, transmit, or distribute malware, viruses, or any other malicious code.
  • Engage in any conduct that interferes with another user's quiet enjoyment of the App.
  • Use the App to gain any commercial advantage, monetize game content belonging to Goblin King Games, or conduct any transaction that would violate Goblin King Games' intellectual property rights or the terms of any permission granted by them.

7. Moderation, Reporting & Enforcement

Automated screening. All free-text content you submit (display names, Player Finder contact notes, league narrative notes, announcements, store submissions) is screened automatically before it is stored. Screening runs in two layers: a local profanity check on your device, and a server-side pass through a third-party AI moderation service (OpenAI); text you submit is transmitted to that service for this purpose. Screening is not perfect and does not guarantee that all objectionable content is caught.

Reporting and blocking. You can report content or a player from the screen on which it appears, and you can block any player at any time. A report captures the offending text and its author so a moderator can review it without needing access to the original surface; misuse of reporting may itself be actioned. Blocked players are managed under Settings → Account → Safety → Blocked Players, and blocking is reversible.

Enforcement. We review reports of objectionable content and abusive behaviour and act on them within 24 hours. We may, at our sole discretion and without prior notice, remove content, decline to publish content, suspend a user's ability to post, or terminate an account that violates these Terms. Serious or repeated violations will result in permanent removal.

8. User-Generated Content

The App allows you to submit user-generated content ("UGC"), including display names, Player Finder contact notes, league narrative notes, store submissions, and troupe names.

You retain all rights you hold in your UGC. By submitting UGC, you grant Tinkavu LLC a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute that content within the App and its backend services solely for the purpose of operating and providing the App to you and other users. We will not use your UGC for any other purpose.

You represent and warrant that:

  • You have the right to submit the content.
  • The content does not infringe any third-party intellectual property rights, privacy rights, or other legal rights.
  • The content complies with these Terms.

9. Fan-Made App & Intellectual Property Disclaimer

Moonstone Companion is an unofficial, fan-made companion application for the Moonstone miniature game. It is not affiliated with, endorsed by, or sponsored by Goblin King Games or any of its affiliates.

All Moonstone trademarks, trade names, game rules, character names, faction names, ability text, card art, artwork, and related intellectual property are the exclusive property of Goblin King Games or their respective owners. Use of these marks and content in the App is for fan informational and game-companion purposes only.

Permission scope: Game content is reproduced in the App with the written permission of Goblin King Games and sourced from their public websites (moonstonethegame.com and shop.moonstonethegame.com). This permission is limited to non-commercial fan use. The App is free and does not generate revenue from Moonstone intellectual property. Nothing in these Terms grants you any rights in Goblin King Games' intellectual property.

Tinkavu LLC owns the App's source code, original user interface design, branding ("Moonstone Companion"), and any original written content it has created.

If you own Moonstone intellectual property, or any other intellectual property that you believe has been included in the App without authorization, and you want anything in the App changed or removed, contact us at info@guillotine-life.com or at the address in section 24 and we will respond promptly.

10. Third-Party Services & Third-Party Terms

The App integrates third-party services, including Supabase (database and authentication), OpenAI (content moderation), LocationIQ (geocoding), OpenFreeMap/OpenStreetMap (map tiles), and Google (authentication and Drive export). Your use of these services is subject to their respective terms of service and privacy policies.

You must comply with applicable third-party terms of agreement when using the App, including, where relevant, the terms of your wireless data provider and of any third-party sign-in service you choose to use (Apple, Google, or Discord).

We are not responsible for the content, practices, or policies of any third-party service. Links or integrations with third-party services do not constitute our endorsement of those services.

If you choose to connect the App to your Google Drive account, that connection is governed by Google's terms of service. You may revoke Drive access at any time via myaccount.google.com/permissions.

11. No Subscriptions or Payments

The App is free to download and use. There are no in-app purchases, subscriptions, or paid features at this time. If we introduce paid features in the future, we will update these Terms and clearly disclose all pricing and billing terms before any purchase.

12. Privacy

Your use of the App is also governed by our Privacy Policy, available at https://ddguildhall.com/apps/moonstone/privacy. The Privacy Policy is incorporated into these Terms by reference.

In summary: we collect an email address and display name for your account (via Sign in with Apple, Google Sign-In, or a magic link); approximate location only when you ask the App to find nearby stores, snapped to a roughly 1 km grid on your device before it is sent to our store-lookup service, used to answer that one query and not retained; and, if you opt in to the Player Finder, a postal code and any contact handles you choose to share. Photographs of your models remain on your device and are never uploaded. Some profile, report, and event data is shared with the Guild Hall service to enable cross-game store and player discovery and cross-app moderation. We do not sell your personal data, we do not show ads, and the App contains no analytics, crash-reporting, or advertising SDK.

13. Maintenance & Support

TINKAVU LLC is solely responsible for providing any maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App. Support requests should be sent to info@guillotine-life.com.

14. Disclaimers of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM SECURITY VULNERABILITIES.
  • WARRANTIES AS TO THE ACCURACY, COMPLETENESS, OR CURRENCY OF ANY GAME DATA, RULES REFERENCES, OR OTHER CONTENT IN THE APP.

TINKAVU LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed above. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price paid for the App (the App is free, so this amount is zero); to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

Game data and rules content in the App are provided for convenience as a study aid and quick reference, sourced from publicly available Goblin King Games materials, and may not reflect the most recent printings, errata, or rule changes. The official Goblin King Games rulebook, cards, and errata are authoritative in the event of any discrepancy.

15. Product Claims

TINKAVU LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

16. Intellectual Property Claims

In the event of any third-party claim that the App, or your possession and use of the App, infringes that third party's intellectual property rights, TINKAVU LLC, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.

17. Legal Compliance & Export Restrictions

You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TINKAVU LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
  • LOSS OF DATA, PROFITS, REVENUES, GOODWILL, OR BUSINESS OPPORTUNITIES.
  • DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS YOU HAVE PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $10.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow the exclusion or limitation of certain types of liability; in those jurisdictions our liability is limited to the greatest extent permitted by law.

19. Apple as Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

20. Termination

By you: You may stop using the App at any time. You may delete your account via Settings → Account → Delete My Account. Uninstalling the App does not delete your account data.

By us: We may suspend or terminate your access to the App at any time, with or without notice, if we determine that you have breached these Terms, if required by law, or if we discontinue the App.

Effect of termination: On termination of your license, your right to use the App ceases immediately. The following sections survive termination and remain in full force: Section 4 (License Restrictions), Section 8 (User-Generated Content, including the license you granted, which remains for content retained consistent with our Privacy Policy), Section 9 (IP Disclaimer), Section 14 (Disclaimers of Warranties), Section 15 (Product Claims), Section 16 (Intellectual Property Claims), Section 18 (Limitation of Liability), Section 19 (Apple as Third-Party Beneficiary), Section 20 (Termination, including this sentence), Section 21 (Governing Law), and Section 22 (General).

21. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the App that is not resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in Volusia County, Florida.

Before initiating any formal proceeding, we encourage you to contact us at info@guillotine-life.com to attempt to resolve the dispute informally. We will make a good-faith effort to resolve any complaint or dispute within 30 days.

Nothing in this section limits your rights to bring claims before a consumer protection authority or supervisory authority in your jurisdiction.

22. General

  • Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Tinkavu LLC regarding the App and supersede any prior agreements on the same subject.
  • Severability: If any provision of these Terms is held to be unenforceable, the remaining provisions continue in full force.
  • Waiver: Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
  • Assignment: We may assign these Terms or any rights under them without your consent. You may not assign these Terms.
  • Third-party beneficiaries: Except as expressly stated in Section 19 (Apple and Apple's subsidiaries) and Section 9 (Goblin King Games' retained intellectual property rights), these Terms do not create any third-party beneficiary rights.

23. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we will:

  1. Update the "Last updated" date at the top.
  2. Post a notice within the App on the first launch after the updated Terms take effect.

Your continued use of the App after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the App and delete your account.
